Guidance on how to fill in the form and provide supporting materials:
1. *Required;
2. The forms of rights holders and agents include, but are not limited to, individuals, companies, enterprises, social groups, etc., and the right holders are the original owners of personal rights, intellectual property rights and other legal rights. Agent refers to a person legally authorized by the right holder. If the right holder entrusts an agent to issue a notice, the agent must provide the power of attorney and other authorization documents of the right holder. Each different notice given by the agent shall be expressly authorized by the right holder separately;
3. Identification documents:
(1) Individuals: including valid ID cards, household registers, passports, Hong Kong and Macao permits, Taiwan Compatriot Permits, Foreigners' Residence Permits, etc. If you provide a national ID card, please provide a copy of the front and back, and if you provide other documents, please provide a copy of the first page and personal page of the certificate (or a scanned copy of the original). The most commonly used valid ID card is a valid national identity card.
(2) Companies, enterprises or social organizations: Enterprises, institutions and social organizations need to provide a copy (or a scanned copy of the original) of the business license, public institution legal person certificate, social group legal person registration certificate and other documents within the validity period and affix the official seal.
4. Specific matters of the complaint: explain the objective situation of the post/content/comment/service/live broadcast that infringes the legitimate rights of the right holder;
5. Notification requirements: the specific measures that need to be taken by the right holder to "LesPark". This includes things like blocking, disconnecting, or deleting links.
6. Preliminary supporting materials: including but not limited to copies of the relevant evidentiary materials that the right holder shall provide to assert its rights as listed in the guidelines for infringement complaints.
(1) Infringement of personal rights:
Ø Right to reputation: the fact of infringement and the fact of infringement damage;
Ø Portrait rights: the source and proof of the likeness.
(2) Intellectual Property Infringement:
In the case of infringement of intellectual property rights, please provide proof of ownership:
Ø Copyright: copyright registration certificate, creative manuscript, proof of publication time of the work, ownership certificate issued by the certification body, and contract for obtaining copyright rights, etc
Ø Trademark rights: trademark registration certificate, trademark license contract;
Ø Patents: patent certificates, patent claims and specifications, etc.
7. If you entrust another person to make a complaint, you should also provide a legal and valid power of attorney and the identity document of the trustee.
8. Signature (or seal) of the complainant (or agent): signed by a natural person, and stamped with an official seal by a non-natural person.
